1. Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Crumb Studios LLC (“Crumb Studios,” “we,” “us,” or “our”). They apply to your use of our games, including Toast Clicker (each a “Game”), and this website, crumbstudiosllc.com (together, the “Services”).
By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you.
2. Apple and the App Store
Our Games are distributed through Apple’s App Store. Your use of a Game is also subject to Apple’s Licensed Application End User License Agreement and the App Store’s terms. If these Terms conflict with Apple’s terms for your use of a Game, Apple’s terms control to the extent required.
You acknowledge that these Terms are between you and Crumb Studios LLC only, not Apple. Apple is not responsible for the Games or their content, and has no obligation to provide maintenance or support for them. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Apple handles App Store payments and refunds under its own policies.
3. License to use our Games
Subject to these Terms, Crumb Studios grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use our Games on Apple devices that you own or control, as permitted by the App Store’s usage rules, for your personal, non-commercial entertainment.
The Games are licensed to you, not sold. We reserve all rights not expressly granted to you.
4. Acceptable use
You agree not to:
- copy, modify, distribute, sell, rent or sublicense any part of the Services, except as permitted by law;
- reverse engineer, decompile or disassemble the Games, or try to get their source code, except where the law does not allow this restriction;
- use cheats, exploits, automation software, hacks or unauthorized third-party software to change a Game or gain an unfair advantage, including on leaderboards;
- interfere with or disrupt the Services or any servers or networks connected to them;
- use the Services in any unlawful way, or to harass, harm or impersonate others; or
- remove or change any copyright, trademark or other notices in the Services.
5. Intellectual property
The Services and all related content, including game code, artwork, characters, audio, text, logos, and the names “Crumb Studios” and “Toast Clicker,” are owned by Crumb Studios LLC or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
If you send us feedback or suggestions, you allow us to use them without any obligation to you.
6. Third-party services
The Games may use services provided by third parties, such as Apple Game Center. Your use of those services is governed by the third party’s terms and privacy policies. We are not responsible for third-party services, and we may not be able to fix problems caused by them.
7. Changes to our Games and progress
We may update, change, suspend or stop offering any Game or feature at any time. Game progress, scores, achievements and other in-game items have no monetary value and cannot be exchanged for money. Game progress may be lost if you delete a Game, change devices, or for other reasons, and we are not responsible for restoring it.

Our Privacy Policy explains how we handle information in connection with the Services.
9. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
Some places do not allow some warranties to be excluded, so some of these exclusions may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CRUMB STUDIOS LLC AND ITS MEMBERS, MANAGERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT BE MORE THAN THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50.
Some places do not allow some liability to be limited, so some of these limits may not apply to you. Nothing in these Terms limits any rights you have that cannot be limited by law.
11. Termination
You may stop using the Services at any time by deleting our Games. We may suspend or end your right to use the Services if you break these Terms. When this happens, the license in these Terms ends, and you must stop using the Services. Sections that by their nature should survive will continue to apply.
12. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules, except where the laws of your home country require otherwise.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page. If you continue to use the Services after an update takes effect, you accept the updated Terms.
14. General
If any part of these Terms cannot be enforced, the rest will stay in effect. If we do not enforce part of these Terms, we have not waived our right to enforce it later. These Terms, together with our Privacy Policy, are the entire agreement between you and Crumb Studios LLC about the Services.
